These terms and conditions shall supersede any subsequent terms or conditions included with any purchase order, whether or not such terms or conditions are signed by 3finsurf Ltd. This does not affect the customer's statutory rights as a UK consumer.

3finsurf.com uses 128 bit SSL encryption on our payment page to ensure that your payment information is safe. When you go though to the payment page and enter your card details, the key or padlock icon in the bottom of your browser will appear locked or highlighted. You will also notice that the address of the web site will change from http://www.The.Biz to https://secure.The.Biz signifying that you are on a secure server.

Availability and Pricing
Upon despatch of your order an email will be sent notifying you of the goods despatched and any appropriate carrier details. All products are offered for sale subject to availability. On the rare occasion that an item of surf clothing or surf gear is ordered and later found to be out of stock, Customer Services will notify you as soon as possible and verify if an exchange is required (at our discretion this will be at a discount for any inconvenience caused) or alternatively a refund.

On rare occasions there may be an item on the site that is incorrectly priced. At our discretion we may:

1. Despatch the goods and refund any difference, or
2. Contact you and inform you of the price change, and verify if you still wish to order the product, or
3. Remove the item from your order, refund the appropriate monetary value and notify you of the cancellation.

3finsurf Ltd. does not take responsibility for products not meeting the exact dimensions and specification listed on this site. 3finsurf Ltd. reserves the right to make any alterations to the price of goods sold on 3finsurf.com without prior notice. All prices are inclusive of V.A.T. and displayed on 3finsurf.com in pounds sterling and must be paid in full, including delivery charges, unless otherwise stated.

You agree that any legal action brought against 3finsurf Ltd. shall be governed by the laws of England without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the 3finsurf.com website shall be an appropriate federal or county court located in Southern England.

We will treat each order for goods, confirmed when you submit your order to us, from the order page, as an offer by you to purchase the goods subject to these terms and conditions. We may require additional verifications or information before accepting any order. 3finsurf Ltd. does not accept orders from exporters, wholesalers, or other customers who intend to resell the products offered by 3finsurf Ltd. You are responsible for ensuring the accuracy of your order. When you place an order we will send an email (first email) to confirm receipt, to clarify your order and to enable you to remedy any mistakes. If we accept your order, we will send you a confirmation email (Second email) [with your order number], and such confirmation shall be our acceptance of a legal contract between yourself and us on these terms and we shall thereafter supply you, subject to availability, with the quantity and specifications of goods set out in your order. However, we will be entitled to refuse to accept your order if we feel it necessary, in which case we will email you as soon as we can to let you know. The shops confirmation will be the printout sent with the dispatched goods.

Typographical Errors
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing, 3finsurf shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. 3finsurf Ltd. shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, 3finsurf Ltd. shall immediately issue a credit to your credit card account in the amount of the charge.

Payment

No other forms of payment are accepted. 3finsurf Ltd. does not offer credit facilities, so we will not deliver goods to you if you do not pay for your order in full at the time of ordering. All prices and carriage costs are displayed in United Kingdom Pounds Sterling (GBP).

Delivery
Delivery shall be made to the delivery address supplied by you at the time of ordering. Any times quoted for delivery are approximate only and 3finsurf Ltd. shall not be liable for any delay in delivery of the products howsoever caused. Goods must be signed for at the delivery address by the customer or by any other person nominated by the customer who is over 18 years of age. It is the customer's responsibility to ensure that any person nominated is over eighteen years old. Under no circumstances will goods be left unattended, for example in a customer's garage or with any person thought to be under the age of 18 years of age.
(a) 3finsurf Ltd. does not take responsibility for goods that are damaged or broken in transit by Royal Mail and/or chosen courier service.
(b) 3finsurf Ltd. does not take responsibility for the product(s) not being to the customers exact liking.
(c) 3finsurf Ltd. does not take responsibility for products reaching a sub-standard level due to package tampering and/or delivery confusion or absence of recipient.
Ownership of the goods shall pass to you once the goods have been delivered, even if the goods have not been received by you in person. Customers who are not present at the time of delivery will be subject to the postal services standard procedure. Notification of an attempted delivery will be made and the subsequent steps to retrieve goods will be made clear.

Returns
3finsurf Ltd. wants you to be totally satisfied with your goods. If you are unhappy with your purchase, for any reason, please return the goods to us (unworn and in their original packing) within 10 days of receipt. If you require an alternative garment please specify colour and size. Credit card refunds can only be credited to the original card with which the goods were bought. Please remember to ask for a proof of posting certificate when returning goods to us as we cannot be held responsible for goods lost in transit. Bikini's/Underwear are non Returnable. Your statuary rights are not affected.
Where you make a valid claim in respect of any shortages or defects and we are liable for the claim, we can at our option make up the shortages or replace the goods free of charge. Alternatively, we may refund the price of the goods in question to you. The decision of which will be at our discretion. If delivery is not refused and you do not notify 3finsurf Ltd. accordingly, 3finsurf Ltd. shall have no liability for any defects and you shall be bound to pay for the goods.

3finsurf Ltd. reserve the right to amend/withdrawl any offer(s) at any time without prior notice. Special offers will be confirmed in secondary email after a purchase has been made.
